Autortiesību likums neparedz autoriem vai blakustiesību subjektiem ekskluzīvas tiesības uz to radīto mūzikas ierakstu klausīšanos, tāpēc, lai klausītos mūziku, licence nav nepieciešama.

Tomēr autoriem un blakustiesību subjektiem ir noteikts tiesību apjoms attiecībā uz to darbu un blakustiesību objektu publisku izpildījumu. Tāpēc ikreiz, kad tiek veikta mūzikas atskaņošana vairākiem ar mūzikas atskaņotāju vai savstarpēji personīgi nesaistītiem sabiedrības locekļiem (neatkarīgi no tā, vai tiek izmantots spotify, radio vai atskaņotas i-tunes nopirktās dziesmas u.tml.) ir jāsaņem autoru un blakustiesību subjektu atļauja jeb licence.

Tātad licences nepieciešamība ir atkarīga no to cilvēku loka un skaita, kam mūzika tiek atskaņota.
