Eversheds comment: Court of Appeal decision sends a clear message on Jackson reforms

Commenting on a Court of Appeal judgement regarding costs in the Andrew Mitchell v News Group Newspapers case, Glenn Newberry, head of costs at global law firm Eversheds, says:
“The Court of Appeal has sent a clear message to practitioners that breaches of the rules will no longer be tolerated and sanctions introduced by the Jackson reforms, however severe they may appear, will be upheld. There is now considerable pressure on solicitors to prepare, exchange and discuss their Costs Budgets in accordance with the rules, and ensure those budgets are monitored and adhered to as the case progresses. We expect clients to be vigilant in ensuring budgets are in place and legal spend is controlled.”
